Legal Transient Vacation Rentals Do Exist on Maui
Popular Travel Magazines have been warning travelers to Maui that the county is cracking down on illegal Vacation Rentals. They suggest that large hotels are your only option. Bunk! We wish folks took the time to explain the whole truth and not use scare tactics to sell magazines or book hotels.

It is true that for the last six years, TVR's (Transient Vacation Rentals) have been a hot topic in Maui County. The County recently announced a program to enforce the current zoning laws and close most Transient Vacation Rentals. However these are only rentals that exist in residential areas, out side of areas that are zoned HOTEL.

In fact, most vacation rental condominiums and villas in South Maui are legal rentals, existing in areas zoned for Hotels and Vacation Rental. To the best of our knowledge, The owners of all the properties on our site operate legal transient vacation rentals. They have a Maui Business License, pay Transient Accommodations tax and General Excise tax on rentals they book and pay the high property tax rates assessed to villas, apartments and condos in the HOTEL ZONED area (8.35% vs 2-5% for other areas). They are all considered legal, short term vacation rentals.

Visitor rentals outside of hotel zone areas like Bed and Breakfast and Ohana type accommodations in residential neighborhoods, are not prohibited either, but General Plan and Community Plan language does restrict or limit vacation rentals in these areas. If you rent one of these accommodations, it is important to confirm with the owner that they are licensed to operate a transient vacation rental property.

According to the Maui Vacation Rental Association (MVRA) the proposed ordinance would simplify the permit process for a very limited number of B&Bs in residential areas, and also allow B&Bs in Rural zoning. Despite these improvements, the main effect of the legislation would be to eliminate most existing visitor homes in NON HOTEL DISTRICTS by disqualifying them for permits. The bills, which were supposed to make it easier for families to open a B&B, actually make it harder -- or impossible -- in most areas of the County.
